1. Validity Towards Entrepreneurs and Definitions
1.1 Scope and Applicability:
The following terms and conditions (hereinafter referred to as "Terms and Conditions") govern all deliveries and services provided by A1 GmbH (hereinafter referred to as "the Seller") to consumers. These Terms and Conditions apply in their version that is valid at the time of the order and are an integral part of all contractual agreements between the Seller and the consumer, unless otherwise expressly agreed in writing.

For the purposes of these Terms and Conditions, a consumer is defined as any natural person who enters into a legal transaction with the Seller for purposes that are predominantly outside their trade, business, or profession. This definition is in accordance with § 13 of the European Civil Code (ECC). The consumer is typically someone who purchases goods or services for personal, domestic, or household use, and not for commercial gain or professional purposes.
1.3 Entrepreneur Definition:
An entrepreneur is any natural or legal person or a partnership with legal capacity who or which, when entering into a legal transaction, acts in the exercise of their trade, business, or profession (§ 14 ECC). These Terms and Conditions are primarily tailored to consumers, and different terms may apply to transactions with entrepreneurs, which will be stipulated in separate agreements or specific contractual conditions.
1.4 Legal Framework:
These Terms and Conditions are framed within the context of the applicable laws and regulations of the European Union. In the event of any conflict between these Terms and Conditions and mandatory statutory provisions, the statutory provisions shall prevail to the extent of such conflict.
1.5 Acceptance of Terms:
By placing an order with the Seller, the consumer acknowledges and agrees to these Terms and Conditions. Any terms and conditions proposed by the consumer that deviate from, conflict with, or add to these Terms and Conditions are expressly rejected unless the Seller has explicitly agreed to them in writing.
1.6 Modifications and Amendments:
The Seller reserves the right to amend these Terms and Conditions at any time without prior notice, provided such amendments do not unreasonably disadvantage the consumer. The version of the Terms and Conditions valid at the time of the order will apply to that order, unless a change to these Terms and Conditions is required by law or government authority (in which case it will apply to orders previously placed by the consumer).
2. Formation of a Contract, Storage of Contract Text
2.1 Conclusion of Contract:
The following regulations apply to orders placed via the webshop. By placing an order through the webshop, the consumer makes a binding offer to conclude a purchase contract.
2.2 Contracting Party:
In the event of a contract conclusion, the contract is made with the entity specified in the webshop’s legal notice.
2.3 Non-Binding Offer:
The presentation of goods in the webshop does not constitute a legally binding offer but serves as a non-binding invitation for the consumer to place an order.
2.4 Order Procedure:
To place an order, the consumer must follow the steps outlined in the webshop:

- Enter contact information and delivery address
- Select shipping method and payment method

2.5 Correction of Input Errors:

3.3 Duties and Taxes for International Deliveries:

These costs are not included in the stated prices and are the sole responsibility of the consumer. It is the consumer's responsibility to check with the relevant local authorities to ascertain any potential costs prior to placing an order. The seller assumes no responsibility for any such additional charges.
3.4 Payment Methods:
The webshop accepts various payment methods, including but not limited to credit card, PayPal, and bank transfer. The available payment options will be presented to the consumer during the checkout process.
3.5 Advance Payment:
If the consumer chooses to pay in advance (e.g., by bank transfer), they are obliged to remit the full purchase price immediately upon conclusion of the contract. The order will not be processed until the full payment has been received by the seller.
3.6 Payment Security:
The consumer’s payment details will be processed using secure encryption technology to protect against unauthorized access and ensure the confidentiality of payment information.
3.7 Pricing Errors:
The seller endeavors to ensure that all prices listed in the webshop are accurate. However, in the event that a product is listed with an incorrect price due to typographical error, error in pricing information received from suppliers, or any other reason, the seller reserves the right to cancel any orders placed for products listed at the incorrect price. The seller will notify the consumer of such cancellation and any payments made for the incorrect orders will be refunded promptly.
3.8 Due Date for Payment:
Unless otherwise agreed, the purchase price is due for payment immediately upon conclusion of the contract. The consumer agrees to provide complete, accurate, and current payment information. In the event of non-payment or payment default, the seller reserves the right to suspend or cancel the order.
3.9 Retention of Title:
The seller retains ownership of the goods until full payment has been received. The consumer is not permitted to pledge, transfer ownership, or otherwise dispose of the goods until full payment has been made. In the event of any breach of this condition, the seller reserves the right to reclaim the goods.
3.10 Fraud Suspicion:
In case of suspicion of fraud, the webshop holds the right to capture the full payment before shipping the product.
4. Shipping and Delivery
4.1 Delivery Timeframe:
Orders placed before 14:00 (2 PM CET, German time) are generally processed on the same business day. The standard order processing time is between one to three business days, Monday through Friday. Once dispatched, the delivery typically takes between one to seven business days, depending on the shipping method chosen and the recipient’s location. For items that are out of stock at the time of purchase, the expected delivery date will be communicated separately via email after the order is placed. The delivery period begins the day after the payment order is issued by the transferring bank or, for other payment methods, the day after the conclusion of the contract. If this period ends on a Saturday, Sunday, or public holiday at the delivery location, it is automatically extended to the next business day.
4.2 Delivery Options and Carriers:
Customers may choose between three delivery options during the checkout process: Eco Delivery, Standard Delivery, and Prio Delivery. Eco Delivery involves a processing time of two to three business days and a delivery time of five to seven business days. Standard Delivery is processed within one to two business days and typically arrives in one to five business days. Prio Delivery is the fastest option, with processing within zero to one business days and delivery in one to three business days. The actual carrier used—such as UPS, DHL, FedEx, GLS, Hermes, PostNord, or Cargoboard—depends on the shipping method selected and the delivery address provided. All logistics partners are carefully selected for reliability and efficiency.
4.3 Delivery Costs:
Shipping costs are calculated as a percentage of the total item value before additional discounts. Eco Delivery is charged at 3%, Standard Delivery at 4%, and Prio Delivery at 5%. Regardless of the order value, minimum shipping costs of EUR 3.95 applies. The final delivery cost is automatically calculated and shown at checkout before the customer confirms the order.
4.4 Transfer of Risk:
The risk of accidental loss or damage to the goods transfers to the buyer only upon successful delivery. Delivery is considered complete when the items are handed over to the buyer or their designated recipient at the delivery address provided during checkout. Until this point, the seller assumes full responsibility for the goods. Once delivered, the buyer assumes all responsibility, including for any loss, theft, damage, or destruction that may occur.
4.5 Freight Forwarder Deliveries:
Deliveries carried out via freight forwarder are made to the curbside only. It is the buyer’s responsibility to arrange and bear any additional costs necessary to transport the goods from the curbside to their final location. The seller is not liable for any damages or losses occurring after the goods have been delivered to the curbside.
4.6 Modification of Shipping Method:
The seller reserves the right to modify the shipping method selected at checkout without prior notice. This may include changes in carrier or shipping service, based on logistical requirements or unforeseen circumstances. Customers will be informed of any such change, and the alternative method will be of equal or higher quality than the original selection.
4.7 Responsibility for Delays:
While every effort is made to adhere to the stated delivery timelines, delays may occur due to factors beyond the seller’s control. These may include customs clearance, natural disasters, strikes, or transportation issues. The seller is not liable for any losses or damages caused by such delays and cannot guarantee compensation for late deliveries.
4.8 Customs and Declaration Costs:
Buyers located outside the Schengen Area are responsible for any customs and declaration-related costs. This includes import duties, taxes, and any additional fees charged by customs authorities in the destination country. Buyers are strongly advised to consult their local customs offices to understand any potential charges before placing an order. The seller is not responsible for customs-related delays or expenses.
4.9 Order Cancellation Due to Shipping Issues:
In certain rare cases, the seller may cancel an order due to unforeseen shipping issues, including excessively high costs, logistical constraints, or regulatory obstacles. If an order must be canceled for such reasons, the customer will be promptly notified and issued a full refund for any payments made. The seller shall not be liable for any additional costs or damages arising from such cancellations.
5. Retention of Title
The seller retains ownership of the goods until full payment of the purchase price.
6. Right of Withdrawal for Consumers
6.1 General Information
Consumers have the right to withdraw from this contract under the following terms. The right of withdrawal must be exercised following the procedure specified on the webshop’s website. Withdrawal cannot be made by letter and must be initiated online or by contacting customer service. All relevant instructions and contact details are provided on the website.
6.2 Withdrawal Before Order Has Been Fulfilled
Consumers may cancel their order at no cost if the order has not yet been fulfilled. In this case, the seller will release the full payment authorization without undue delay and no later than ten business days from receiving the withdrawal notification. The release will be processed using the original method of payment, unless expressly agreed otherwise. No restocking fee or return shipping cost applies if the order is withdrawn before fulfillment.
6.3 Withdrawal After Order Has Been Fulfilled – Return Procedure
The withdrawal period is ninety (90) days from the day the consumer or a third party, who is not the carrier, takes physical possession of the goods. To meet the deadline, the consumer must send notice of withdrawal before the period expires. The consumer must submit a return request via the webshop’s website, and the return must be approved before the goods are sent back. The consumer must return the goods within fourteen (14) days after the return request is approved. The return deadline is met if the goods are handed to the shipping carrier before the period expires. The return shipping label will be provided by the seller.
6.4 Withdrawal After Order Has Been Fulfilled – Refund and Fees
To cover handling, inspection, and prepaid return shipping, a deduction of 3% of the product’s original value will be applied to the refund amount, unless the return is for an exchange. The seller will refund the purchase amount excluding the original shipping cost, unless the return is due to seller error or a defective product. The refund will be issued no later than ten business days after the returned goods have been received or proof of return has been provided, whichever occurs first. Refunds will be processed using the original method of payment or issued as store credit, unless otherwise agreed. If the refund must be processed through a different method than the original payment, it may take up to 180 days to complete. The consumer will not be charged additional fees for the refund.
6.5 Reshipment of Unclaimed Orders:
If an order is not picked up by the customer and is returned to the seller, the seller will reship the order to the customer with additional costs for the buyer. These additional costs will include original shipping costs, any return shipping charges and any other applicable fees.
6.6 Condition of Returned Goods:
If a product is returned damaged or without the original packaging, the seller reserves the right to deduct an appropriate amount from the refund to cover the loss in value. The exact amount deducted will depend on the condition of the returned goods and the extent to which the product has been used or damaged.
6.7 Exclusions from Right of Withdrawal:
The right of withdrawal does not apply to the purchase of products that are manufactured specifically to the customer's specifications, are clearly tailored to personal needs, or are manufactured on demand. Such custom or made-to-order products cannot be cancelled or returned once the manufacturing process has begun.
7. Warranty
7.1 Statutory Warranty Provisions:
All goods sold by the webshop are subject to the statutory warranty provisions applicable within the European Union. This includes the consumer's rights in case of defects as outlined in the relevant EU directives and regulations.
7.2 Scope of Warranty:
The seller warrants that the goods delivered are free from defects in material and workmanship at the time of delivery. The warranty period for consumers is two years from the date of delivery of the goods. For entrepreneurs, the warranty period is one year from the date of delivery. The seller's liability under the statutory warranty provisions is limited to the repair or replacement of the defective goods.
7.3 Notification of Defects:
The consumer is obliged to inspect the goods immediately upon receipt and to notify the seller of any obvious defects without undue delay. Hidden defects must be reported to the seller as soon as they are discovered. Failure to notify the seller in a timely manner may result in the consumer forfeiting their warranty rights.
7.4 Procedure for Warranty Claims:
To make a warranty claim, the consumer must follow the procedure specified on the webshop’s website. The consumer must contact customer service and provide a detailed description of the defect, along with any relevant documentation, such as photographs or videos, to support the claim. The seller will review the claim and, if necessary, provide instructions for the return of the defective goods.
7.5 Repair or Replacement:
If the goods are found to be defective, the seller will, at its discretion, either repair the goods or replace them with goods of equivalent quality. If repair or replacement is not possible or would involve disproportionate costs, the consumer may choose to receive a reduction in price or rescind the contract. 7.6 Exclusions from Warranty:
The warranty does not cover defects or damages resulting from:

8. Contract Language
8.1 Language of Communication:
The primary language for communication, including customer service and support, will be the language chosen by the buyer when entering the website. The seller will make reasonable efforts to communicate with the buyer in the selected language.
8.2 Legally Binding Version:
The legally binding version of all content, including these terms and conditions, is the English version. In case of any discrepancies or inconsistencies between the English version and versions in other languages, the English version shall prevail.
8.3 Translation Disclaimer:
The seller is not responsible for any losses or misunderstandings arising from translations of content into other languages. Automatic translations are provided for convenience only, and the seller does not guarantee the accuracy or completeness of these translations.
8.4 AI-Generated Content:
The seller is not responsible for any phrases, statements, or content generated by artificial intelligence (AI) tools used on the website. All AI-generated content is provided "as is" and should be independently verified by the buyer.
